Although every effort has been made to ensure accuracy, MDCPartners or Anju Software shall not be held responsible for loss or damage caused by errors, omissions, or misinterpretation of the Indication Content other than those that arise out of the negligence or willful misconduct of MDCPartners or Anju Software. Furthermore, MDCPartners and Anju Software expressly disclaim any and all liability to any person, company, or other third party, whether a client or not, with respect to the reliance thereupon of the Indication Content as long as the Indication Content has not been affected by the negligence or willful misconduct of MDCPartners or Anju Software. With respect to Indication Content available from Software System, except for representations and warranties specified elsewhere in this Agreement, MDCPartners and Anju Software make no warranty, express or implied, including the warranties of merchantability and fitness for a particular purpose, or assumes any legal liability or responsibility for the accuracy, completeness, or usefulness of any information, apparatus, product, or process disclosed except to the extent the accuracy, completeness, or usefulness of any information, apparatus, product or process is affected by the negligence or willful misconduct of MDCPartners or Anju Software.
